Rules and guidelines for using AI Korean Comic
Welcome to AI Korean Comic ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the AI Korean Comic website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. Please read these Terms carefully before using our Service.
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the date at the bottom of these Terms and, in some cases, we may provide additional notice (such as adding a statement to our homepage or sending you an email notification). Your continued use of the Service after such changes indicates your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant that: (i) you are at least 13 years of age; (ii) you have not previously been suspended or removed from the Service; and (iii) your use of the Service is in compliance with all applicable laws and regulations. If you are using the Service on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that organization to these Terms and you agree to be bound by these Terms on behalf of that organization.
To use certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to disable any user account at any time in our sole discretion, including if we believe you have violated these Terms.
Our Service allows you to upload, submit, store, send, and receive content, including photos for transformation into Korean comic style. You retain all rights in, and are solely responsible for, the content you post to the Service ("User Content"). By uploading User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute your User Content solely for the purpose of providing the Service to you.
You agree not to upload, post, or transmit any User Content that:
We reserve the right, but are not obligated, to review, monitor, and remove User Content at our sole discretion at any time and for any reason, without notice to you.
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of AI Korean Comic and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AI Korean Comic.
With respect to the AI-generated images created through our Service:
Some aspects of the Service may be provided for a fee. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms as we may update them from time to time. We may add new services for additional fees and charges, or amend fees and charges for existing services at any time in our sole discretion.
All payments are non-refundable except as expressly set forth in these Terms or as required by applicable law. You are responsible for paying all taxes associated with your use of the Service, except for those based on our income. If you dispute any charges, you must notify us within 30 days of the date of billing.
You can cancel your subscription at any time by logging into your account settings or contacting us. Your cancellation will take effect at the end of the current paid term. If you cancel the Service before the end of your current paid term, we will not refund any fees already paid to us.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AI KOREAN COMIC AND ITS SUPPLIERS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEITHER AI KOREAN COMIC NOR ITS SUPPLIERS AND LICENSORS MAKES ANY WARRANTY THAT THE SERVICE WILL BE ERROR-FREE OR THAT ACCESS THERETO WILL BE CONTINUOUS OR UNINTERRUPTED. YOU UNDERSTAND THAT YOU DOWNLOAD FROM, OR OTHERWISE OBTAIN CONTENT OR SERVICES THROUGH, THE SERVICE AT YOUR OWN DISCRETION AND RISK.
IN NO EVENT WILL AI KOREAN COMIC, OR ITS SUPPLIERS OR LICENSORS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THESE TERMS UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY FOR: (i) ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES; (iii) FOR INTERRUPTION OF USE OR LOSS OR CORRUPTION OF DATA; OR (iv) FOR ANY AMOUNTS THAT EXCEED THE FEES PAID BY YOU TO AI KOREAN COMIC UNDER THESE TERMS DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION. AI KOREAN COMIC SHALL HAVE NO LIABILITY FOR ANY FAILURE OR DELAY DUE TO MATTERS BEYOND THEIR REASONABLE CONTROL. THE FOREGOING SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
You agree to indemnify and hold harmless AI Korean Comic, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Service, including but not limited to your violation of these Terms.
These Terms and any action related thereto will be governed by the laws of South Korea without regard to its conflict of law provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the courts located in Seoul, South Korea, and you waive any objection to jurisdiction and venue in such courts.
These Terms constitute the entire agreement between you and AI Korean Comic regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and AI Korean Comic. You may be subject to additional terms and conditions that apply when you use third-party services, third-party content or third-party software.
If any part of these Terms is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
Any failure by AI Korean Comic to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of AI Korean Comic. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
